TERMS AND CONDITIONS

Your Commitment To Us
When you ask for your holiday booking to be confirmed, you are accepting that these Terms and Conditions form the basis of any contract between America As You Like It and yourself, which is subject to English law and the exclusive jurisdiction of the English Courts.

DEPOSIT/PAYMENT
A deposit of 20% is required when you make your booking unless advised otherwise at time of booking. The balance must be paid at least 8 weeks before travel. If you are booking within 8 weeks of travel full payment is due immediately. Alteration or cancellation of the booking by you, once a Confirmation of Booking has been issued, will be subject to the provisions of Alteration and cancellation below.

CONSUMER PROTECTION
The air holidays and flights in this brochure are ATOL protected, since we hold an Air Travel Organiser’s Licence granted by the Civil Aviation Authority.  Our ATOL number is 2966.  In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad, or will arrange to refund any money you have paid to us for an advanced booking including a flight.  For further information, visit the ATOL website at www.atol.org.uk.

PRICE GUARANTEE
The prices shown in our brochure were calculated on the exchange rate of £1 = $1.85.
We reserve the right to make changes to and correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking.

Once the price of your chosen holiday has been confirmed at the time of booking, we will only increase it in the following circumstances. A surcharge will be payable, if transportation costs (e.g. fuel, scheduled airfares and any other airline surcharges which are part of the contract between airlines (and their agents) and the tour operator) or dues, taxes or fees payable for services such as landing taxes at airports or ports increase or decrease or our costs increase or decrease as a result of any changes in the exchange rates which have been used to calculate the cost of your holiday.

ALTERATIONS TO A CONFIRMED BOOKING
if you decide to alter any details of your booking after it has been accepted by America As You Like It, you must advise the company in writing. Provided we are advised more that 8 weeks prior to departure, we will endeavor to make the changes and limit the administration fee to £20 per person. Alterations within 8 weeks of travel, changes to flight dates, and alterations to the names of people travelling may be treated as cancellation.

CANCELLING YOUR HOLIDAY
If you do not pay the balance of the holiday at the prescribed time, America As You Like It reserves the right, after due notice to you, to cancel the booking. In this event, or if you cancel after the booking is accepted, the deposit will be forfeited. Additionally if cancellation occurs after the balance has been received by us, the following cancellation charges will be payable by you. Dates are calculated from the date on which America As You Like It receives written notice of the Cancellation.

Prior to 42 days - deposit forfeited
42-29 - 30% of total holiday cost
28-15 - 60% of total holiday cost
14-1 - 90% of total holiday cost
Less than 24 hours - 100% of total holiday cost

NB: Some small inns and self catering properties have more strict cancellation policies. You will be advised of these at time of booking.
The company reserves the right in any circumstances to cancel your holiday, and in this event we will return to you all money paid by you to the company, or allow you to purchase an alternative holiday of a similar standard if available. Only in exceptional circumstances will the holiday be cancelled within 8 weeks of departure and compensation as set out above will be paid, unless the reason for us cancelling your holiday is outside our control (see Important Note).

COMPANY LIABILITY

IF YOU HAVE A COMPLAINT
In the unlikely event that you have any reason to complain or experience any problems with your holiday whilst away, you must immediately inform the supplier of the service(s) in question. Until we know about a problem or complaint, we cannot begin to resolve it. Most problems can be resolved quickly and in resort. If you remain dissatisfied, however, you must write to us within 28 days of your return to the UK giving your booking reference and full details of your complaint. Only the party leader should write to us. For all complaints and claims which do not involve death, personal injury or illness, we regret we cannot accept liability if you fail to notify the complaint or claim entirely in accordance with this clause.

DOCUMENTATION
The majority of UK passport holders can travel Visa free to the USA, under the US-VISIT programme. Travellers must meet the following conditions:

a. Hold a full, valid 10 year machine-readable passport. In addition to this, passports issued after 26 October 2006 must be e-passports. Passports issued between 26 October 2005 & 25 October 2006, must contain a digitally printed photograph. Passports issued prior to 26 October 2006, must be machine-readable but do not need to meet the other conditions.
b. Hold a return ticket to the UK or for an onward journey out of the USA.
c. Be staying in the USA for less that 90 days.
d. Hold a valid travel authorisation. From January 2009 the US Government will require that all visitors complete and Electronic Travel Authorisation, which replaces the paper I-94 forms previously completed on the aircraft. You can apply for this any time prior to your visit, but it is recommended that you do so at least 72 hours prior to travel. Simply visit https:esta.cbp.dhs.gov and complete the details to receive your application number. Alternatively you can contact us with your passport details and we ill submit the information on your behalf.

British Passport holders designated 'British Subjects' do require a visa. It is your responsibility to ensure that you have the correct passport and visas to gain entry to the countries included in your travel arrangements. If you fail to do so, we have no liability to you for any cost, loss or damage which you suffer, nor will we refund you the cost of any unused portion of your travel arrangements.

IF YOU HAVE A COMPLAINT
Should you have any complaint you are urged to discuss it at the time with the relevant authority, eg. hotel manager, airline supervisor, etc. If your complaint is not resolved please notify the company immediately. We will normally be able to rectify matters quickly. Failure to contact the local supplier or America As You Like It will adversely affect your customer rights. If it is not possible to resolve your complaint during your holiday, please contact the company soon as possible within 28 days of your return.
